Despite several years of inspections, correspondence and attempted repairs, a number of issues with the property remain unresolved.

Issues that still need resolution

These are the main issues that remain unresolved and the outcome we believe is needed.

Kitchen

The kitchen worktop is damaged and has a poorly executed mitred joint. We believe the worktop needs to be replaced and installed correctly.

We also previously discussed changes to the fridge/freezer orientation that would improve access and allow the door alignment issues to be resolved.

The remaining issues identified in the second RISA report have not been fully addressed.

We believe these defects should be remediated in accordance with the findings of that report.

Bedroom insulation

Bedroom one remains colder than the rest of the house. It cools more quickly and takes longer to warm up.

We believe a new independent thermal survey is needed to identify the root cause before further remedial works are carried out.

Garden

The garden areas have not been prepared to an acceptable standard.

We believe the appropriate remediation includes removing debris, decompacting the ground, installing suitable topsoil and returfing.

Final offer

Willow Tree Housing Partnership’s position

Willow Tree Housing Partnership have issued what they describe as their final offer.

The offer included

  • Payment for both RISA inspections.
  • Agreement to fund remedial work identified in the second RISA report, based on a quote now over 12 months old.
  • A commitment to continue working towards a “definitive conclusion” regarding the cold bedroom.
  • Reference to use of a RICS arbitration service.
  • A revised compensation offer.
  • A garden remediation proposal costing approximately £15,000, with Willow Tree Housing Partnership expecting us to pay 50%.

Liability not accepted

Willow Tree Housing Partnership do not accept liability for the remaining defects.

We considered the offer incomplete and unclear in several key areas.

Our concerns

Why we asked for clarification

We asked Willow Tree Housing Partnership to clarify several parts of the offer before we could properly assess it.

Missing scope and detail

The proposal did not clearly define the scope of the garden works, the expected outcome, or how the RICS arbitration process would operate.

Kitchen issues not addressed

The offer did not address the damaged worktop, poorly executed mitred joint, or fridge/freezer access and alignment issues.

Outdated cost assumptions

The quote referenced for window remediation is now over 17 months old, so costs are likely to have changed.

Expenses not considered

The offer did not address reasonable costs we incurred, including preparation work for remediation and additional heating costs.

Garden contribution

We do not consider it reasonable to contribute to garden works that we believe should have been completed to an acceptable standard before handover.

Questions not answered

Willow Tree Housing Partnership responded four months later with a single-page reply that did not address the questions raised.

Counter proposal

Our proposed way forward

Following legal advice, we submitted a counter proposal focused on resolving the remaining issues.

Expenses

We requested reimbursement for reasonable and legitimate costs, including both RISA inspections, preparation work for remedial works, and a contribution towards increased heating costs.

Windows

We proposed obtaining an updated quote for the window remediation works and requested that Willow Tree Housing Partnership cover the cost.

Garden

We set out the works required to bring the garden to an acceptable standard and requested that Willow Tree Housing Partnership cover those costs, with our contribution limited to 50% of returfing.

Bedroom insulation

We proposed a new independent thermal survey and requested that Willow Tree Housing Partnership fund both the survey and any remedial works identified.

Compensation and apology

We accepted the compensation figure previously offered and requested a formal apology for the stress and disruption caused.

Current position

Awaiting response

Our counter proposal was submitted on 26 March 2026. We requested a written response within 28 days, by 24 April 2026.

We also wrote to EG Carter & Co outlining the issues and asking them to propose a resolution.
